what is the penalty for Racial Breach of the Peace, I was attacked & am waiting to be a witness at trial.?
I was recently victim to an unprovoked attack by a woman in her 50′s she called me a fat B++ch, a Half cast Gypsy B++ch, told me to F off back to England, get a wash etc, the verbal attack went on to become violent, she was charged with Racial Breach of the peace. The day after she was charged & appeared in court then released on Bail with special conditions after she pleaded not guilty. I noticed bruises on my body so informed the police who have now taken photographs as evidence. is it possible to add Assault or Battery to the charge at a later date and what kind of penalties could possibly be imposed for racial breach of the peace or RBP and Assault or Battery. there were witnesses to all of the above, I did not retaliate verbally or physically and it was a wholly unprovoked and shocking attack witnessed by others,
The CPS can amend the charges if they consider there is sufficient evidence.
Sentencing is not a linear or tabular matter. the Judge has a huge amount of discretion adn the sentence could range from a conditional discharge to 6m in prison.
A lot would depend on previous convictions etc.
